FAMILY LAW MATTERS
-
We have extensive experience in assisting individuals involved in
the breakdown of a marriage or family unit. We appreciate that this time in an individual’s
life is highly stressful and can be very complicated depending upon
the circumstances of the parties. We have handled thousands of files of a
domestic nature and we are equipped to deal with complex and delicate
matters in an expeditious manner. It is always our preference to assist the client
to mediate the issues in dispute where possible, as
it is more civil and conducive to fair outcomes, but sometimes a court
appearance cannot be avoided because one party is not prepared to negotiate,
or affairs are such that negotiation is not a viable alternative. The first step for you is to
download, print off and complete our Family Matter Form. The form
is located at the bottom of the page titled "Family & Divorce and is
available in either Corel WordPerfect or Microsoft Word formats.
If you are unable to download and/or print the form then please contact
our
office by email or telephone (905-826-5670) to
arrange for a copy of this form. Once you
have completed the Family Matter Form, email or fax it back to our
office. At this time a clerk will contact you to set up an appointment.
It would be helpful if you brought to your appointment any documentation you might possess
confirming any income, assets and/or liabilities.
Mr. Day has considerable trial experience and has appeared in all
levels of court in Ontario (trial and appellate). He has acted for a number of
years as counsel for children through the Office of the Official Guardian (now
the Office of the Children’s Lawyer) and has represented The
Ministry of Community and Social Services in Family Matters.
Grounds for divorce are typically based on a one year separation. Proceedings can be commenced before the year has
passed. An uncontested
divorce takes about four months. A contested divorce can take between one
and three years.

CORPORATE MATTERS

We have a number of corporate clients and provide
general counsel on both corporate and commercial matters. We maintain
Minute Books and corporate records for small and large companies,
as well as sole proprietorships and partnerships and we provide ongoing advice on
issues of a commercial nature. We incorporate both Provincial and
Federal
companies and also act for non-profit organizations. Ongoing
filings are important to maintain as are annual minutes and corporate
resolutions. We have developed a system for regular corporate
filings to help keep your business organized. In conjunction with your accountants we can
ensure that your corporate records are up to date. Usual corporate affairs
such as shareholder agreements, amalgamations, acquisitions, reorganizations,
share freezes, corporate finance matters, continuations, dissolutions can be handled by
our experienced staff.

LAST WILL AND ESTATE MATTERS

A properly drafted Last Will is essential for a good estate plan. Over the years, we have developed an expertise in assisting clients
prepare sound and effective estate plans. For the process to be
effective advice is not limited to legal input. A knowledgeable
financial planner, insurance agent and accountant is as important as
good legal advice and drafting. The approach is multi-disciplined and
a knowledgeable client is the best start to a good estate plan.
Original Wills prepared by our office are stored in fire-proof cabinets and copies are stored
electronically off-site. In addition to your Last Will and
Testament, it is important to have a Personal Care Power of
Attorney and a Continuing Power of Attorney in place. The laws relating
to Powers of Attorney have changed significantly in the last few years
and a review of this aspect of your estate is important in order to
minimize governmental interference in the affairs of your family and
those you wish to provide for. We have over the years acted for a
number of trust companies and have assisted in the preparation of last
wills and testaments for their clients. We have also assisted many
clients and their estates with the administration of estates at the appropriate
time.

REAL ESTATE

We are located in a quickly growing community. The corollary to
this is we are involved in residential real estate, both on the sale
and purchase side, and we would be pleased to assist you in this area
if the need arises. We have block fees for
"straight-forward" conveyancing matters. Our tariff for
standard transactions is accessed at "Standard Fees". Most
transactions fall into this category but sometimes problems do arise
and we are competent to deal with the more difficult transactions. The
cost is dependant on the time involvement which is discussed and
agreed aupon in
advance.
Real estate conveyancing is dramatically changing in Ontario with
the advent of electronic registration and computer databanks for
property registration. We have kept our skills,
computer hardware & software current. If you
would like us to assist you in your real estate needs, we would ask
that you fax us the fully signed copy of the agreement with all
attachments and that you complete and fax, deliver or email our Real
Estate Intake Form to us.
