FAMILY AND DIVORCE

We have extensive experience in assisting individuals involved in the breakdown of a marriage or family unit. We appreciate that this time in an individual’s life is highly stressful and can be very complicated depending upon the circumstances of the parties.  We have handled thousands of files of a domestic nature and we are equipped to deal with complex and delicate matters in an expeditious manner.  It is always our preference to assist the client to mediate the issues in dispute where possible, as it is more civil and conducive to fair outcomes, but sometimes a court appearance cannot be avoided because one party is not prepared to negotiate, or affairs are such that negotiation is not a viable alternative.  The first step is to complete our Family Matter Form.  This form is available at the bottom of this page in both Corel Wordperfect and Microsoft Word formats.  Simply click on the preferred format, open the document, print it off and complete it to the best of your ability.  If you are unable to open or print this form please call our office (905-826-5670) and arrange a time to drop in and pick a blank form up from Reception.  Once you have completed the Family Matter Form,  email or fax it back to our office and at this time a clerk will contact you to set up an appointment.  It would be very helpful if you brought any documentation you might possess confirming any income, assets and/or liabilities.

Mr. Day has considerable trial experience and has appeared in all levels of court in Ontario (trial and appellate). He has acted for a number of years as counsel for children through the Office of the Official Guardian (now the Office of the Children’s Lawyer) and has represented The Ministry of Community and Social Services in Family Matters.

Grounds for divorce are typically based on a one year separation.  Proceedings can be commenced before the year has passed.  An Uncontested Divorce takes about four months where a Contested Divorce can take anywhere between one and three years.

Fees for a straight forward Separation Agreement:

Fee:                                $2,000.00 + GST

Fees for a straight forward Cohabitation Agreement or Marriage Contract:

Fee:                                $1,500.00 + GST

Fees for an Uncontested Divorce:

Fee:                                $850.00 + GST
Disbursements:            $550.00 - $650.00

Fees for a Contested Divorce/Family Matters:

Mr. Day's hourly rate is $425.  To begin the process we require a retainer of usually between $3,000.00 - $10,000.00.  The retainer will depend on the complexity of the issues.

Fees for an Opinion Letter:

Regarding the force and effect of a foreign divorce  -  $300.00 + GST (unless Mr. Day advises otherwise for more complicated matters)
